Summary Terms and conditions

1.1. To use our Platform, you must agree to the Terms outlined in the documents. If you do not agree with any of these Terms, please refrain from using our services.

1.2. These Terms, in conjunction with your booking confirmation email and any information provided prior to booking, establish the legal framework for Service Providers offering Travel Experiences on our Platform.

1.3. Should any issues arise during your Travel Experience, you can reach out to the local call center, contact the designated WhatsApp number, or email bookings@explorebeds.com. Additionally, you can lodge a complaint by utilizing an online dispute resolution service or emailing dispute@explorebeds.com.

About terms and conditions

2.1. Upon confirming your booking, you are consenting to comply with the specified Terms and any supplementary conditions disclosed throughout the reservation process.

2.2. If specific terms are deemed void by an authoritative body, the remaining terms will continue to be enforced.

2.3. The initial rendition of these Terms is in English, and in instances of dispute or incongruity between the English version and a translation, the English Terms will take precedence unless local laws state otherwise.

About explorebeds.com

3.1. When you book an accommodation, holidays or attraction on explorebeds.com, we are  responsible for the Platform – but not the Travel Experience itself as the travel experiences booked on the platform are sourced from local providers.

3.2. We collaborates with local support service providers for customer assistance and account management, who do not have control over the platform, their own platform, legal relationships with users, or provide travel experiences. They also do not represent explorebeds.com or act on their behalf in any contractual matters.

Our portal

4.1. We receive information from Service Providers, and while we cannot guarantee its accuracy, we exercise reasonable care and professional diligence when providing our Platform. Unless we have failed in our duty or been negligent, we are not liable for any errors, interruptions, or missing information. We strive to promptly address any issues once they come to our attention as part of our ongoing efforts to enhance the customer experience on explorebeds.com.

4.2. Variations in designs, phrasings, products, etc., may be displayed to different individuals on our Platform as part of our research into user reactions. Consequently, some services or terms may not be visible during your visit. It is important to note that our Platform does not serve as an endorsement of any Service Provider or their offerings; we are not involved in the agreements between you and the Service Provider. The Service Provider bears sole responsibility for the Travel Experience.

4.3. To make a Booking, you may need to register an Account or use a guest account option. It is essential to ensure that all your information is accurate and current – including payment and contact details – to avoid any issues accessing your Travel Experiences. Safeguard your Account credentials and refrain from sharing them with others; you are accountable for all activities associated with your Account.

4.4. We present available offers tailored for you in what we believe is your preferred language; however, you can switch languages at any time. Unless specified otherwise, users must be at least 18 years old to utilize the Platform.

Pricing and calculations

5.1. By confirming a Booking, you agree to cover the expenses associated with the Travel Experience, which includes any applicable charges and taxes.

5.2. Prices displayed may have been rounded to the nearest whole number for convenience. However, your payment will be based on the rounded price (though any difference will be negligible).

5.3. Clear mistakes and obvious misprints do not hold weight in agreements. For instance, if you mistakenly book a premium service or a night in a luxury suite that was erroneously priced at usd 1 or value which clearly states as mis print, your reservation may be voided and any payments refunded.

5.4. A marked-out price represents the cost of an equivalent Booking without any discounts applied (like-for-like denotes identical dates, policies, quality of accommodation or service class of travel, etc.).

Payment Procedures

6.1. Certain products and services may necessitate an initial payment or a payment made at the time of your travel.

  • If we handle your payment, either us or our partner will oversee the transaction process with the service provider to guarantee its successful completion. Your payment in such instances serves as the full settlement of the amount owed.
  • Typically, payment from the Service Provider will be collected in person at the commencement of your Travel Experience. However, there is also a possibility that your credit card will be charged at the time of booking or upon departure from your Accommodation. The timing of payment is determined by the Upfront Payment policy of the Service Provider, which is communicated to you during the booking procedure.

6.2. Prior to making a booking, ensure to review the Service Provider’s policy on Upfront Payments, which may be required and non-refundable. We do not influence or bear responsibility for this policy, but it does not impact your rights in case of any issues with your Travel Experience.

6.3. If the currency of your payment method differs from the payment currency, additional fees may be charged by your bank or payment provider (or their service providers). For instance, if you are charged in dollars by a hotel while using a credit card denominated in Euros. Any such occurrences will be communicated during the booking process and relate to the default currency of your payment method.

* Generally, local providers will handle payments in their local currency, subject to conditions and policies set by the service provider.

6.4. In case of suspected fraudulent activity or unauthorized use of your Payment Method, promptly contact your payment provider. For quick resolutions and assistance with any issues related to fraud or unauthorized use, you can also reach out to fraud@explorebeds.com

Our Policies

7.1. By making a Booking, you agree to the policies outlined during the booking process. These policies cover various aspects such as cancellation rules, age requirements, security deposits, group booking supplements, extra amenities like additional beds or breakfast, pet policies, and accepted payment methods. You can access this information on our Platform through the Service Provider’s pages, during booking, in the fine print, and in confirmation emails or tickets if applicable.

7.2. If you need to cancel a Booking or fail to show up, any fees or refunds will be determined by the Service Provider’s specific cancellation policy. Some Bookings may incur charges for cancellations while others allow free cancellations up to a certain deadline.

7.3. For Travel Experiences requiring advance payment (including all costs and potential damage deposits), be aware that the Service Provider reserves the right to cancel your Booking without notice if they cannot collect the remaining balance on time. In such cases, any non-refundable payments will be subject to their discretion. It is your responsibility to ensure timely payment by verifying your banking details and available funds.

7.4. Should you anticipate arriving late for your Booking, communicate promptly with the Service Provider regarding your expected arrival time. Your punctuality is crucial as we are not liable for any resulting costs such as Booking cancellations or additional service fees.

7.5. As the person initiating the Booking process, you hold responsibility for overseeing group behavior and actions related to the Travel Experience. Obtain consent from all individuals before sharing their personal information with us.

Communication with the Service Provider

8.1. While we are here to assist in facilitating communication with your Service Provider, it is important to note that we do not assume responsibility for the Travel Experience or any actions taken by the Service Provider. We cannot guarantee that your messages will be read or that your requests will be fulfilled. Merely contacting them, or being contacted by them, does not automatically warrant legal recourse. For assistance, please reach out to us through our Call Center or email bookings@explorebeds.com.

Measures against unacceptable behavior

9.1. In the event of a breach of the aforementioned terms or failure to comply with relevant laws or regulations, we reserve the right to: prohibit you from making any new bookings, revoke any existing bookings, restrict your access to our platform, customer service, or account.

9.2. If a booking is canceled by us due to such circumstances, you may not be eligible for a refund depending on the situation. We will provide an explanation for the cancellation unless disclosing this information would violate laws or impede fraud detection. If you believe your booking was canceled in error, please reach out to our customer service team or contact via email at bookings@explorebeds.com.

Limitation of liability

10.1. Our liability, or that of the Service Provider, cannot be limited under certain circumstances: negligence resulting in death or personal injury, fraud, gross negligence, or actions that cannot lawfully have limitations.

10.2. If you violate any of these Terms or those of the Service Provider, we will not be responsible for any costs you may incur. We are not responsible for unforeseeable losses or damages at the time of booking or events beyond our control.

10.3. We do not guarantee anything about the products and services of Service Providers beyond what is explicitly stated in these stated Terms & Conditions.

10.4. Our liability, or that of any Service Provider, is limited to reasonably foreseeable losses in connection with your bookings. We will be seeking these compensation on your behalf from the service providers.

10.5. These Terms & Condisitons apply only to you and us; no third party other than the Service Provider is entitled to do anything under these terms.

Applicable law and forum

11.1. These Terms are governed by UAE law (for accommodations, services or attractions).

11.2. If you are a consumer living outside UAE (as defined above):

  • You may bring a legal action against us:
    • in the courts of the country where you live, or
    • in the courts in UAE (for accommodations, services or attractions)
  • We may bring a legal action against you in the courts of the country where you live or in UAE.

Modification of Services clause

12.1. We reserve the right to update these Terms, and if the changes are significant, we will notify you beforehand unless mandated by law. If you disagree with the modifications, kindly refrain from using our Platform.

12.2. Your ongoing use of our Platform following the implementation of the alterations indicates your acceptance of the updated Terms & Conditions.

12.3. Any prior bookings will adhere to the Terms & Conditions in place at the time of booking.
